By using hpdsites.com or engaging Hunters Point Digital ("HPD," "we," "us") for services, you agree to these terms. They're written in plain English on purpose. If anything is unclear, ask us.
We design, build, and maintain custom websites for small and medium businesses. Our services are described on our pricing page (Starter, Growth, Professional). The exact scope of any engagement is set out in a written quote we send before work begins.
You can cancel monthly support at any time. We'll keep your site running through the end of the billing period you've already paid for. After that, we can either hand over the code and DNS so you can host it yourself, or migrate you off. Your call.
If after Day 5 of an engagement you don't love what we've built, you don't pay the second half of the setup fee. The first half (our deposit) is non-refundable to cover work already done.
"Content updates" included with monthly support are small changes (under 30 minutes each: text edits, photo swaps, hours/price changes, broken-link fixes). Larger work like new pages, redesigns, e-commerce, or custom integrations is quoted separately. Limits per plan are listed on our pricing page.
To the maximum extent allowed by law, our total liability for any claim arising out of an engagement is capped at the fees you've paid us in the prior 12 months. We're not liable for indirect or consequential losses.
Anything you tell us about your business that isn't already public, like financials, customer lists, or strategies, we keep confidential. Same goes the other way: our pricing exceptions, internal processes, etc. stay between us.
Either of us can end an engagement with written notice if the other materially breaches these terms and doesn't fix it within 14 days. Sections about ownership, confidentiality, and liability survive termination.
These terms are governed by the laws of the State of New York. Any dispute will be handled in the courts of New York County, NY.
If we update these terms, we'll change the date at the top and email anyone with an active engagement. Continued use of our services after the update means you accept the changes.
